1.  Who we are

This website, aegidomartialarts.shop, is operated by Shiu Lung Kung Fu Pty Ltd ABN 80 106 583 591, trading as AEGIDŌ (“we”, “us”, “our”). Our contact details are in clause 16.

These terms apply to every order you place with us. Please read them before ordering. If you do not agree with them, please do not place an order.

2.  Nothing here reduces your legal rights

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights. If anything in these terms conflicts with them, your rights under the Australian Consumer Law apply.

Our Returns and Refunds Policy explains what happens if something is wrong with your order, and forms part of these terms.

3.  Your account

• Accounts are for adults. If you are ordering for a child, including a junior member of our school, please order through your own account as their parent or guardian.
• Please give accurate details when you register and keep them up to date, so we can deliver your order and contact you about it.
• Keep your password confidential. You are responsible for orders placed through your account, unless someone used it without your knowledge and it was not your fault.
• You can close your account at any time by contacting us.

4.  Members-only products

Some products are available only to current members of our school. Access to them depends on your membership being current, and we add that access to your account.

If your school membership ends, we will remove access to members-only products from your account. This does not affect any order we have already accepted, and it does not affect the rest of your account, which you can keep using for everything else we sell.

5.  Prices

• All prices are in Australian dollars.
• We are not registered for GST, so no GST is charged on your order and none is shown separately at checkout.
• Delivery cost is additional. It is calculated and shown to you at checkout before you pay, so you always see the full amount before paying.
• The price that applies to your order is the price shown when you place it. If we change our prices later, the change does not affect an order we have already accepted.
• If a price is obviously wrong, for example through a typing or system error, we will contact you before making your order. You can then choose to go ahead at the correct price, or cancel and receive a full refund. We will not simply charge you the higher amount.

6.  Placing an order

When you place an order you are making an offer to buy. We accept your offer when we send you an email confirming that your order has been accepted or is being made. A contract between us is formed at that point.

Occasionally we may be unable to accept an order, for example if a product can no longer be produced, a limited edition has sold out, or we cannot deliver to your address. If that happens we will tell you and give you a full refund of anything you have paid.

7.  Payment

Payment is taken at checkout through our payment provider, WooPayments (WooCommerce Payments). We do not receive or store your full card number. We make your order once payment has been received.

8.  Made to order

• Every item is printed or embroidered for you after you order. Nothing is taken from existing stock.
• Production takes time before your parcel is posted. Current production and delivery estimates are shown on the product page and at checkout.
• Please check the size guide on the product page before ordering, because items are made to your chosen size.
• Screens show colour differently, so a printed item can look slightly different from how it appears on your device.

9.  Delivery

• We deliver to the address you give us, so please check it carefully. If an address is wrong or incomplete and the parcel is returned to us, we will contact you and a reshipping charge may apply.
• Delivery dates we give are estimates, not guarantees, because delivery is carried out by third-party couriers.
• We are responsible for your order until it is delivered to your address. If your order does not arrive, contact us and we will resolve it.

10.  Limited editions

Some products are sold as numbered limited editions. When an edition sells out, it closes and we do not produce it again.

If you are entitled to a replacement for a limited-edition item and we cannot supply one because the edition has closed, you will receive a full refund instead.

11.  Our brand and designs

AEGIDŌ is a registered trade mark. The AEGIDŌ crest, our product designs, photographs, and the text on this website are owned by us or licensed to us, and are protected by law.

• You may use this website to browse and buy for your own personal use.
• You must not copy, reproduce, print, embroider or sell our crest, designs or images, or use them on your own products or merchandise, without our written permission.
• Buying a product does not give you any right to reproduce the design on it.

12.  Liability

Your rights under the Australian Consumer Law, including the consumer guarantees, are not affected by this clause.

Beyond those rights, and only to the extent the law allows us to limit it, we are not liable for loss that does not arise directly from our supply of the product to you, such as lost profits or loss caused by something outside our reasonable control.

13.  Using this website

Please do not attempt to interfere with this website, gain unauthorised access to it, use it to send unlawful or abusive content, or use it in a way that damages or disrupts it for other people.

We aim to keep the website available, but we may need to take it offline for maintenance or for reasons outside our control.

14.  Changes to these terms

We may update these terms, for example when our products, suppliers or legal obligations change. The date at the top shows when they last changed.

The terms that apply to your order are the ones published when you placed it. Changes we make later do not apply to an order we have already accepted.

15.  Suspending or ending your access

We may suspend or close your account if you seriously or repeatedly breach these terms, for example by misusing our designs or the website. Where it is practical to do so, we will tell you first and give you a chance to put it right.

You may close your account at any time. Closing your account does not affect any order already accepted, or your rights under the Australian Consumer Law.

16.  Governing law

These terms are governed by the laws of NEW SOUTH WALES  Australia. You and we may bring proceedings in the courts of that state or territory, and this does not limit any right you have to bring a claim or complaint elsewhere, including with a consumer protection body.
